In some instances, particularly where the information concerned is commercially sensitive or related to ongoing negotiations, particularly regarding First Nations and property negotiations, the Sea-to-Sky Highway Improvement Project must balance the public interest in disclosure with the public interest in a fair process that delivers value for money through a commercial negotiation. In addition, releasing confidential, commercially-sensitive information could jeopardize the Ministry’s ability to negotiate a contract that delivers the best highway improvements at the most competitive price.
